Navigating complex regulations: Why it matters

Always in view: upcoming sustainability legislation

With sustainability legislation evolving at a rapid pace, staying ahead of these changes is crucial for businesses across industries. Regulatory shifts can have a profound impact on daily operations, from product design to packaging standards. For companies like Utz Group, which are committed to sustainability and the circular economy, understanding these laws is not just about compliance—it’s about leading the way in environmentally conscious business practices.

Utz Group stays ahead of upcoming legislation and adapts to new sustainability requirements, particularly in the packaging sector. We’ll take a deep dive into the European Packaging and Packaging Waste Regulation (PPWR) and how our proactive approach ensures our products meet or exceed regulatory demands.

Keeping up with international and national legislation

The importance of a proactive approach

At Utz Group, we monitor both national and international legislative developments, which allows us to adapt quickly and efficiently to upcoming changes. By actively tracking changes, we can pass valuable insights on to our employees, enabling them to handle customer inquiries and regulatory requirements with confidence.

  • Local and international focus: In addition to local regulations in the countries where we operate, international rules—especially from the EU—have a significant impact.
  • Key EU directives. We closely follow negotiations on major EU directives like:
    • PPWR – Packaging and Packaging Waste Regulation
    • CSRD – Corporate Sustainability Reporting Directive
    • WFD – Waste Framework Directive
    • CSDDD – Coporate Sustainability Due Diligence Directive

Our involvement doesn’t stop at observation; we actively contribute our technical knowledge to the negotiation processes, helping to shape these directives.

Spotlight on the PPWR

What is the PPWR?

The European Packaging and Packaging Waste Regulation (PPWR) is one of the most impactful pieces of sustainability legislation in the EU. Its goal is to reduce packaging waste across all EU member states by setting specific targets for waste prevention and packaging reuse.

Key elements of the PPWR include:

  • Waste reduction targets for EU member states
  • Mandatory reuse of specific types of packaging
  • Bans on single-use packaging in various sectors
  • Requirements for minimizing packaging volume

These ambitious goals have led to extensive discussions and revisions. Despite the regulation being adopted in June 2024, many details are yet to be clarified through delegated acts, which will define specific measures for implementation.

The challenges and opportunities for the packaging industry

The PPWR has introduced several important firsts, such as binding EU-wide waste prevention targets and recycling requirements. However, the regulation also presents challenges, particularly in its design requirements for recyclable packaging and the use of post-consumer recycled materials (PCR). The exclusion of paper and board packaging from many provisions is also problematic, as it disrupts material neutrality and may cause market distortions.

While the goals of the PPWR are broadly welcomed, especially for reuse and recycling, the extensive requirements will necessitate careful planning and innovation within the packaging sector.
